Many aliens, immigrants or beneficiaries applying for lawful permanent resident status have been denied, arrested and or placed in Removal before an Immigration Judge for various reasons. Filing applications incorrectly, or being petitioned by a spouse who is not eligible to file can also result in one of these situations. There are many important factors to assess before any type of immigration application is filed. For example, whether a potential immigrant has a criminal background, no matter how long ago it occurred, must be reviewed before filing any type of immigration application.
Comprehensive Immigration Reform
It is widely anticipated that an overhaul of the U.S. immigration laws will occur in 2011. This will be a system that puts checks and balances into our immigration framework. The main theme of this proposal will involve some form of legalization for the roughly 12 million immigrants residing in the U.S. without documentation. One of the key aspects of this new framework will likely include a process where undocumented immigrants will register with the government. Legalization would entail:
- Background checks to assess criminal activities.
- English competency requirements to establish their ability to speak and write English
- Proof of payment of past taxes while residing in the U.S.
- Payment of a fine for their past unrecorded status in the United States.
Another aspect of the legalization program would be a work program to provide agricultural job opportunities. And yet another component would be the long awaited DREAM Act which gives legal status to students who came in to the United States years ago when they were young children.
There are several other provisions of the proposal as well, including: reduction of family based backlogs; securing borders; improved due process for immigrants; efficient employment verification; employment options and Overall, public support for improved immigration laws is high. The American public recognizes that a comprehensive overhaul of the current immigration system is the real solution to a very old problem.
