Understanding The Divorce Process In Florida

There is a lot to consider when preparing for and navigating through Florida's divorce process. Below are the key components of the process:

  • Opening a case: Our attorneys file all necessary legal documents to begin divorce proceedings. This essentially asks the court to grant the divorce and address the issues of equitable distribution of assets and liabilities, child support, alimony, child custody (time-sharing), and attorneys' fees.
  • Timelines: Our firm handles the filing and serving of your divorce petition and related pleadings. After you serve your spouse, they will have 20 days to respond and 45 days to provide their own financial affidavit and mandatory disclosure.
  • Mediation: All family law cases must go through mediation. This is the process where you, your spouse and the attorneys sit down with a third-party to try to resolve your case. If you cannot reach an agreement via mediation, the case will proceed to trial.
