Residents stunned by dramatic increase in HOA dues

When a buyer moves into a community with a homeowners’ association, he or she knows that it is a requirement to pay dues to the HOA. There are many benefits to living in an HOA community, and these dues go toward many of the amenities enjoyed by residents. One Florida community was recently shocked to learn that their HOA dues increased dramatically, and some are asking for an investigation into what they believe was a sham election. 

Possible misconduct by the HOA 

The HOA rates in this community increased by 300 to 400% after the election of new HOA board members. Residents believe the election was fraudulent, and as a result, 15 formal complaints have been filed with the Florida Department of Business and Professional Regulation. These claims dispute the results of the HOA election in this community of approximately 6,500 residents. 

The homeowners state that the sharp rate increases are unaffordable for most residents. Notice of the increase in these fees was given without cause or justification from the HOA board. The specific amount of rate increases differs according to the location within the larger area as it is divided into several smaller communities.  

Fighting back against unfair rate increases 

These HOA fee increases are an example of why a Florida homeowner may fight back against the unfair actions of an HOA. In some cases, there may be grounds to take legal action to fight back against unreasonable fees and other violations of a homeowner’s rights.
